CANDIDATE TERMS AND CONDITIONS
The registration form and these terms and conditions constitute the entire agreement between TNB and the Candidate and
extinguish all previous agreements or understandings relative to its subject matter. Proceeding to use the services of TNB,
including use of this website shall constitute acceptance by the candidate of these terms and conditions.
3. CANDIDATE REGISTRATION
Candidate registration is confirmed once the candidate has sent their CV to TNB via email, post or in hand.By registering with the TNB you agree to these candidate terms and conditions.
The candidate agrees to provide accurate information and legitimate documents to the TNB upon registration and at all times. Giving false information to the TNB could lead to a child being endangered and will be taken very seriously. This may result in legal proceedings and police involvement.
Important information required by the TNB will include but is not limited to the following:
Previous childcare experience and employers names
Acquired skills eg. Newborn care
Reason for the termination of previous employment
Criminal history clearance
Validity of relevant qualifications and first aid certificate
Valid identification documents
All parties agree that the Agency shall not be liable to the Candidate, or to any other person, including, but not limited to the Candidate’s family or their successors, heirs and assigns, or any other person, for incidental or consequential losses, damages or expenses, directly or indirectly arising from any action or failure to act by a client. It is agreed that there is no representation, warranty, collateral agreement or condition affecting this agreement except as expressed in it.
The Candidate acknowledges having read, understood and agreed to the terms and conditions of this agreement which are set forth in this agreement
An introduction is made when TNB notifies their Client of a Candidate's name and contact details.
An introduction is made when the TNB notifies the candidate of any of the details to a position that has become available including the contact details of the family. After this time the candidate must not contact the family in question without the knowledge of the TNB for any reason.
If an offer of employment is accepted by the candidate as a result of an introduction by the TNB the candidate must inform the TNB immediately.
The candidate must never accept an offer of employment, contract or booking of any nature directly from a family/client or through any other employment/nanny agency or third party after being introduced through the TNB. This will result in legal proceeding being taken by the TNB against the candidate.
The candidate must also never accept an offer of employment, booking or business opportunity of any kind from any third party or family connected or introduced by the client/family.
In the case of a temporary contract booking, the candidate must always inform the TNB immediately if the client offers a repeat booking or bookings at a later date.
Failure to adhere with the above will result in agency fees being applied to both the candidate and the client and all registrations will be cancelled.
Non-Solicitation of Clients: By registering with TNB, the Candidate agrees that they will not, without the prior written consent of the TNB, at any time during their registration or involvement with the TNB, or at anytime in the future, either individually or through any company controlled by the candidate and either on their own behalf or on behalf of any person competing or endeavouring to compete with the TNB, directly or indirectly solicit, endeavour to solicit or gain the custom of, canvass or interfere with any person who is a client of the TNB or use personal knowledge of or influence over any such client to or for their own benefit or that of any other person competing with the TNB at anytime in the future.
Non-Solicitation of candidates: By registering with TNB, the Candidate agrees that they will not, without the prior written consent of the TNB, at any time during their registration with the TNB, or at anytime in the future, either individually or through any company controlled by the Candidate and either on their behalf or on behalf of any other person competing or endeavouring to compete with the TNB, directly or indirectly solicit for employment, or endeavour to employ or to retain as an independent contractor or agent, any person who is an employee or registered candidate of the TNB at anytime in the future.
The TNB will endeavour to ensure but does not guarantee the suitability of any position or family situation to a Candidate. The TNB will provide accurate details of the position to the best of our knowledge before an application for employment is made by the Candidate. The Candidate is responsible for satisfying themselves as to the suitability of a particular position and family situation.
The Candidate hereby releases the TNB and its officers, agents, employees, and affiliates from all claims, losses, liabilities, injuries, demands, suits, actions, causes of actions of every kind arising out of or resulting from the action of TNB or the release of any information by TNB.
7. REGISTRATION TERMINATION
The Agency has the right to terminate the registration of a Candidate at any time, for any reason, including but not limited to unprofessional conduct, misrepresentation of our image, and company name, reported job incompetence, client solicitation, drug or alcohol abuse, previous or current criminal record.
Any information supplied by the TNB to the Candidate including personal and contact information for our family clients and other registered candidates is confidential and should not be given to any other third party under any circumstance.
The Candidate may be asked to provide constructive feedback and comments on the jobs that they complete and the clients that they work for. The feedback sought is his or her opinion on matters that are relevant to each specific job and Clients and is not to be of a malicious or defamatory nature.
TNB regards legitimate feedback on subjects including (but are not limited to):
-The reliability of the Client; did the client accurately describe the job (e.g. number of children and hours etc)
-Did the client pay the agreed salary stated in your contract?
-Were the premises suitable and safe (i.e. was there any problem with an unfenced pool for example)?
-Did the Candidate feel unsafe for any reason? Please contact TNB directly and without delay if you have any safety concerns about the job or the client.
-Were the duties specified in the employment or booking contract accurate to that of the Clients requirements of you in a working day.
9. CANDIDATE/CLIENT COMPLIANCE
The Agency reserves the right to change or add to the above Terms and Conditions without prior notification, however all changes will be posted on this website. It's the Candidates responsibility to check these Terms and Conditions in case there are any changes. Continuing to use the site and our services after a change has been made is your acceptance of the changes.
TNB has the right to cancel an offer of engagement or interviews at anytime if the Client or the Candidate
- does not agree to abide by the Terms & Conditions displayed on this website OR provided by TNB.
- Provides misleading or incorrect information to TNB.
- Provides information on a registration form that is suspected to be untrue.
- give TNB any indication that they do not intend to pay the agency fees or sign, agree to or adhere to the agency terms and conditions.
-Fail to provide documents or references to complete their registration.
-Fail to advise TNB of contact or arrangements of any kind made between Candidate and Client.
TNB shall not be held liable, under any circumstances for any loss, damages or expense incurred
by the a cancellation of an employment engagement made by TNB, The Candidate or the Client at anytime
by the actions of TNB, the Candidate or the Client at anytime
